Last updated: Nov 6, 2026 This is an agreement between you and D4vil ("we", "us") about your use of the E4RTH R4DIO app ("the app"). By downloading or using the app, you accept these terms. If you do not accept them, do not use the app. This agreement is between you and us only, not Apple. Apple's required terms are in the "Apple terms" section below. We give you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple devices that you own or control, for your own non-commercial listening, as the App Store usage rules allow. The app is licensed, not sold. We keep all rights in the app, its design, artwork and code that this agreement does not give you. You may not: - Copy, modify, sell, rent, lease or distribute the app or its parts. - Reverse engineer, decompile or try to get the source code, except where the law allows it. - Remove or bypass the app's M4X locks, or share a purchase in a way the App Store does not permit. - Use the app for anything unlawful, or in a way that overloads or interferes with the services it connects to. - Record, rebroadcast or republish radio streams played through the app, except as the station and the law allow. M4X is a one-time in-app purchase that unlocks extra features: alternate app icons, the mini player controls, audio-reactive visuals, extra genre filters, unlimited favorites and the red colorway. It is not a subscription and does not renew. Payment, receipts, refunds and Family Sharing are handled by Apple under Apple's terms, and we cannot issue refunds ourselves. You can restore your purchase on any device signed in to the same Apple account from the M4X screen. We may change which features M4X includes in future versions; features you already have will not be removed without notice. The app does not own, host or control the radio stations. Station listings come from the community-run Radio Browser directory, and the audio comes straight from each station's own server. Stations can change, go offline, or carry content you find offensive or inaccurate, and we are not responsible for it. Each station's content belongs to its owner and is subject to their terms. The app also uses open-source libraries, which stay under their own licenses. The app is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We do not promise that it will be uninterrupted, error-free, or that any station will play. To the fullest extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost data or profits, arising from your use of the app. Our total liability for any claim is limited to the amount you paid for the app or M4X in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you, and nothing here limits rights the law gives you as a consumer. This agreement lasts until it ends. It ends automatically if you break it, and you can end it at any time by deleting the app. We may update these terms; the "last updated" date will change, and continuing to use the app after an update means you accept it. These terms apply because you get the app from the Apple App Store. - Apple is not a party. This agreement is between you and us, not Apple. We, not Apple, are responsible for the app and its content. - Scope of license. The license is limited to use on Apple-branded products you own or control, under the App Store Terms of Service. - Maintenance and support. We are solely responsible for support and maintenance. Apple has no obligation to provide any. - Warranty. If the app fails to meet a warranty, you may tell Apple and Apple will refund the purchase price of the app. Apple has no other warranty obligation for the app. We are responsible for any other claims, losses or costs from a failure to meet a warranty. - Product claims. We, not Apple, are responsible for claims about the app, including product liability, legal or regulatory compliance, and consumer protection or privacy claims. - Intellectual property. If a third party claims the app infringes its rights, we, not Apple, are responsible for the investigation, defense and settlement of that claim. - Legal compliance. You confirm that you are not in a country under a U.S. government embargo or listed as a restricted party. - Third-party terms. You must follow any applicable third-party terms, such as your mobile carrier's data terms. - Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this agreement. Once you accept it, Apple may enforce it against you. This agreement is governed by applicable law, and nothing here limits the rights your local consumer law gives you.
